These Terms and Conditions ("Terms") constitute a binding agreement between you ("User" or "you") and CareerDec ("Company," "we," or "us"). These Terms govern your access to and use of our website (www.careerdec.com) and mobile application (the "App"), collectively referred to as the "Platform," and all services, content, and features offered through the Platform (collectively, the "Services").

By accessing, browsing, registering on, or using the Platform and Services in any way, whether as a registered user or guest, you agree to be bound by these Terms and Conditions. If you do not agree to these Terms, you must immediately discontinue use of the Platform. Your use of the Platform signifies your acceptance of these Terms and our Privacy Policy.

Please read these Terms carefully. These Terms, along with our Privacy Policy, form the entire agreement between you and CareerDec regarding your use of the Platform. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

CareerDec reserves the right to modify these Terms at any time without prior notice. Your continued use of the Platform following any such modifications constitutes your acceptance of the revised Terms. We recommend reviewing these Terms periodically for updates.

1 USER ELIGIBILITY AND REGISTRATION

  • To use the Platform, you must be at least 13 years of age (or the minimum age required in your jurisdiction). If you are under 18 years of age, you represent and warrant that you have obtained parental or guardian consent to use the Platform and agree to these Terms on their behalf.
  • When registering for the Platform, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and password. You agree to be fully responsible for all activities that occur under your account and to notify us immediately of any unauthorized use of your account or any other breach of security.

2 USER OBLIGATIONS AND PROHIBITED CONDUCT

  • Use automated tools, bots, or scripts to access, scrape, or collect data from the Platform without explicit authorization.
  • Violate any intellectual property rights, including copyrights, trademarks, patents, or trade secrets of CareerDec or third parties.
  • Engage in spamming, sending unsolicited messages, or engaging in any form of abusive communication.
  • Any violation of these obligations may result in suspension or termination of your account without refund.

3 INTELLECTUAL PROPERTY RIGHTS

  • All content, materials, and services available on the Platform, including but not limited to text, graphics, images, videos, study materials, mock tests, software, code, and design, are the exclusive property of CareerDec or its content suppliers and are protected by applicable copyright, trademark, and other intellectual property laws.
  • You are granted a limited, non-exclusive, non-transferable license to access and use the Platform and its content solely for personal, non-commercial purposes. You may not reproduce, modify, distribute, transmit, publish, or create derivative works from any content without prior written permission from CareerDec.

4 USER-GENERATED CONTENT

  • By posting, uploading, or submitting any content to the Platform (including comments, questions, photos, or any other material), you grant CareerDec a worldwide, non-exclusive, royalty-free, perpetual, and irrevocable license to use, reproduce, modify, publish, distribute, and display such content for the purpose of providing and improving the Services.
  • You represent and warrant that any content you submit does not infringe upon any third-party intellectual property rights or other rights, and that you have the right to grant CareerDec the aforementioned license. CareerDec does not claim ownership of your original content but reserves the right to use it in accordance with these Terms.

5 PAYMENT AND BILLING

  • Certain features and services on the Platform may require payment. All fees are stated in Indian Rupees (INR) or such other currency as specified at the time of purchase. Prices are subject to change without notice, but any changes will not affect orders already placed.
  • Payment Processing: Payments are processed through authorized payment gateways such as PayU, PayTM, and other third-party payment processors. Your payment information is transmitted directly to these payment processors and is not stored by CareerDec. You agree that all payment information you provide is accurate, current, and complete.
  • Refund Policy: Refunds are subject to our Refund Policy, which is available on the Platform. In general, refund requests must be made within 7 days of purchase. Refunds will be processed to the original payment method within 5-10 business days.
  • Recurring Charges: If you subscribe to a recurring service, you authorize CareerDec to charge your payment method on a recurring basis according to the subscription terms. You may cancel your subscription at any time through your account settings.
  • CareerDec assumes no liability for any charges incurred through unauthorized use of your account or payment method.

6 LIMITATION OF LIABILITY

  • TO THE FULLEST EXTENT PERMITTED BY LAW, CAREERDEC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE PLATFORM, EVEN IF CAREERDEC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  • THE TOTAL LIABILITY OF CAREERDEC FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO CAREERDEC IN THE 12 MONTHS PRECEDING THE CLAIM OR ₹100, WHICHEVER IS GREATER.

7 DISCLAIMER OF WARRANTIES

  • THE PLATFORM AND ALL SERVICES, CONTENT, AND MATERIALS PROVIDED THEREIN ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. CAREERDEC MAKES NO WARRANTY, EXPRESS OR IMPLIED, REGARDING THE PLATFORM OR SERVICES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
  • CareerDec does not warrant that the Platform will be uninterrupted, error-free, or secure, or that any defects will be corrected. CareerDec shall not be liable for any damages resulting from unauthorized access, viruses, or other malicious code that may be transmitted to your device.

8 INDEMNIFICATION

  • You agree to indemnify, defend, and hold harmless CareerDec and its affiliates, officers, directors, employees, agents, and service providers from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Platform, your violation of these Terms, your infringement of any intellectual property or other rights of any person or entity, or any other conduct or activity related to your account.

9 THIRD-PARTY LINKS AND SERVICES

  • The Platform may contain links to third-party websites, applications, and services that are not controlled by CareerDec. These Terms do not apply to third-party websites or services, and CareerDec is not responsible for the content, accuracy, or practices of such third parties.
  • Your use of third-party services is at your own risk and is subject to the terms and conditions of such third parties. CareerDec strongly recommends reviewing the privacy policies and terms of service of any third-party services before providing your personal information or engaging with such services.

10 TERMINATION AND SUSPENSION

  • CareerDec reserves the right to suspend or terminate your account and access to the Platform at any time, without notice or liability, for any reason, including if you violate these Terms, engage in prohibited conduct, or fail to maintain accurate account information.
  • Upon termination or suspension of your account, your right to access the Platform and Services will immediately cease. CareerDec shall not be liable to you or any third party for the termination of your account or the consequences thereof.

11 GOVERNING LAW AND JURISDICTION

  • These Terms and Conditions are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform shall be exclusively resolved in the courts of India.
  • You agree to submit to the personal and exclusive jurisdiction of the courts located in India and waive any objection to venue or inconvenient forum.
